Specialist Litigation
Our client, a well reputed local UAE bank with more than 40 years presence in the market, is looking to hire a Litigations Specialist for the bank's team in Abu Dhabi and report to Head of Litigation.
YOUR MISSIONS
- Complex Litigation Management:
- Handle complex legal matters involving multiple stakeholders and competing interests, providing expert legal counsel, and safeguarding the bank’s interests in dispute resolution processes.
- Develop and implement comprehensive litigation strategies aligned with the bank’s objectives and risk appetite.
- Analyze and interpret laws, regulations, and court decisions to assess their impact on ongoing and potential litigation.
- Contract Review and Risk Assessment:
- Review and analyze the bank's business contracts in accordance with applicable laws, focusing on litigation-related risks.
- Identify potential legal risks and recommend mitigation strategies to prevent future litigation.
- Provide expert advice on contractual matters to various business units from a litigation perspective.
- Legal Research and Reporting:
- Conduct comprehensive legal research on complex banking and finance litigation issues.
- Prepare detailed reports and review the organization’s litigation strategy pertaining to ongoing and potential legal matters.
- Stay abreast of legal developments in banking sector litigation and share insights with relevant stakeholders.
- Internal Legal Support:
- Serve as the primary point of contact for internal business teams seeking litigation-related legal support.
- Provide timely and practical legal advice to various departments on dispute resolution and litigation avoidance.
- Collaborate with cross-functional teams to integrate litigation considerations into business processes.
- Compliance Assistance:
- Assist business units in complying with various legal requirements to minimize litigation risks.
- Collaborate with compliance teams to develop and implement policies and procedures that align with regulatory standards and reduce legal exposure.
- Conduct training sessions for staff on relevant legal topics and litigation risk management.
- Litigation Representation:
- Represent the organization in litigation proceedings before semi-judicial committees and judicial bodies.
- Develop and execute litigation strategies in collaboration with external counsel when necessary.
- Manage and monitor ongoing litigation to ensure the bank’s interests are protected and optimal outcomes are achieved.
- Stakeholder Management:
- Build and maintain strong relationships with internal clients, external counsel, and relevant judicial authorities.
- Liaise with regulatory bodies, opposing counsel, and other relevant parties as required during litigation processes.
- Represent the legal department in cross-functional projects and initiatives related to dispute resolution.
- Risk Management:
- Identify and assess legal risks in business processes and decision-making that may lead to litigation.
- Recommend and implement risk mitigation strategies in collaboration with other departments to prevent legal disputes.
- Contribute to the development and maintenance of the bank’s legal risk management framework, with a focus on litigation avoidance.
- Knowledge Management:
- Develop and maintain legal knowledge bases and resources for the department, particularly on litigation related matters.
- Mentor junior legal staff in litigation practices and procedures, fostering their professional development.
- Contribute to the continuous improvement of legal processes and best practices in dispute resolution.
- Regulatory Compliance:
- Ensure compliance with UAE Central Bank regulations, federal laws, and international banking standards in all litigation matters.
- Monitor and analyze regulatory changes, assessing their impact on the bank’s litigation strategies and dispute resolution approaches.
- Provide expert guidance on regulatory matters to senior management and business units to prevent compliance-related litigation.
YOUR BACKGROUND
- You hold a Master’s degree in Law with a focus on Litigation or Dispute Resolution, and LLB or equivalent legal qualification from a recognized institution.
- You possess a professional legal qualification (e.g., bar admission) in the UAE or a recognized international jurisdiction, preferably, you also have an additional qualifications in Islamic Finance Law or International Arbitration.
- You have at least 8 years of progressive legal experience, with at least 5 years specializing in banking and finance litigation, and you have a knowledge of UAE court procedures, banking laws, and regulatory requirements.
- You have a proven track record in managing complex litigation and achieving favorable outcome.
